Terms and Conditions & Privacy Policy for the
“TABAC X Grillmeister David Social Media Sweepstakes”

 

§ 1 General

The organizer of the “TABAC X Grillmeister David Social Media Sweepstakes” (hereinafter referred to as “Sweepstakes”) is MÄURER & WIRTZ GmbH & Co. KG (hereinafter referred to as “Organizer”).

The sweepstakes is not affiliated with Instagram and its associated companies and is in no way sponsored, supported, or organized by Instagram and its associated companies. The recipient of the information provided by the sweepstakes participant is not Instagram or its associated companies, but MÄURER & WIRTZ GmbH & Co. KG. The online presence of MÄURER & WIRTZ GmbH & Co. KG can be found at: www.m-w.de. Instagram, Facebook, and their associated companies are not contact persons for questions, comments, or complaints regarding the sweepstakes. All questions, comments, or complaints regarding the sweepstakes must be directed exclusively to MÄURER & WIRTZ GmbH & Co. KG. Instagram and its associated companies shall be indemnified against all damages, losses, and expenses of any kind (including reasonable attorney's fees and costs) resulting from claims related to the sweepstakes (including its publication and organization).

Participation in the sweepstakes is generally free of charge, but costs may be incurred by third parties for the transmission of participant data, e.g., costs for data connection.

§ 2 Sweepstakes Procedure

The sweepstakes begins on March 23, 2026. Each participant can participate in the sweepstakes by following the Tabac Fragrances & Grillmeister David channel and liking the post until March 29, 2026.

The winner will be chosen by lot from all participants who follow @tabacfagrances & @grillmeisterdavid and have liked the post. The winner will be notified of the prize by private message by April 1, 2026, and asked to send the contact details required for prize delivery, which enable the prizes to be sent by mail, via private message. The prize notification may be in the "Other" folder of your account's messages. If the winner does not respond by April 3, 2026, at the latest, the claim to the prize will be forfeited, and a new winner will be drawn.

After the winner has responded via private message, the prizes will be sent to the winners.

§ 3 Prizes

We are raffling off a total of 1x Tabac Fragrances surprise package and a premium steak course for 8 people – with Grillmeister David. The date for the premium steak course for 8 people will be individually arranged with Grillmeister David and the winner and is independent of the organizer's availability. There is no claim to a specific date.

The organizers Tabac Fragrances & Grillmeister David are entitled to exchange the announced prizes at any time and replace them with other equivalent prizes. In these cases, the winner has no claims whatsoever against the organizer or against legally affiliated companies. A cash payment of the voucher's value is not possible.

§ 4 Eligibility

The minimum age for participation in the sweepstakes is 18 years. Each participant must reside in Germany. Employees of the organizer and MÄURER & WIRTZ GmbH & Co. KG or employees of companies affiliated with the organizer, as well as their family members, are excluded from participation. This regulation also applies to freelance and permanent employees of companies and agencies involved in the planning, organization, and execution of the sweepstakes.

There is no right to participate in the sweepstakes. The organizer may reject data sets without stating reasons and reserves the right to exclude participants from the sweepstakes who violate these terms and conditions. Participants who attempt to disrupt or manipulate the sweepstakes process or gain an advantage through the use of unauthorized means may also be excluded from participation. Multiple participation is not permitted.

In cases of doubt, the organizer, stating an e-mail address, is entitled to request proof of identity from the winner, e.g., by copy of a suitable identification document. In the event that such proof is not provided in a timely manner, this may lead to exclusion from the sweepstakes or loss of prize eligibility. Unnecessary information on the identification document will be named to the winner beforehand and can be blacked out before submission.

§ 5 General Disclaimer

With regard to the execution of the sweepstakes, the organizer is only liable for damages based on a grossly negligent breach of duty by the organizer or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent. The organizer is also liable for breaches of an essential contractual obligation ("cardinal duty"). In the case of simple negligence, however, this liability is limited to typical damages foreseeable at the time of contract conclusion. In all other cases, the organizer's liability is expressly excluded.

In particular, the organizer assumes no liability for omissions, interruptions, deletions, delays in the execution of the sweepstakes or transmission, failures of communication lines, as well as theft or destruction or unauthorized access to or alteration of content and/or communications of the participants.

§ 6 Sweepstakes Cancellation

The organizer reserves the right to cancel or terminate the sweepstakes without prior notice and without stating reasons. The organizer will only exercise this option if proper execution cannot be guaranteed for legal or technical reasons.

§ 7 Data Protection Information

All entered and/or uploaded data are subject to statutory data protection regulations.

Participation in the sweepstakes requires commenting on an Instagram post by the organizer via the participant's personal profile. Depending on the participant's profile settings, personal data such as name, first name, etc., will be disclosed. The participant's Instagram profile will only be used to identify the winner and to notify them of the prize via private Instagram message. The contact details of the winner communicated after the prize notification via Instagram message, which enable the prizes to be sent by mail, will be used by the organizer or any service provider possibly engaged for the purpose of conducting and processing the sweepstakes to send the prize with a prize letter. No further use of the data will take place. All personal data will be treated by the organizer in accordance with the legal provisions (in particular the applicable data protection laws). The organizer is entitled to process the personal data obtained in the context of the sweepstakes for the aforementioned purpose to the extent required in accordance with the applicable legal data protection provisions. After the sweepstakes has been conducted and processed, all data will be deleted again, unless the participant has explicitly requested further contact or similar or has consented to such. The participant has, among other things, a right to information or rectification according to legal requirements and can revoke their participation in the sweepstakes and/or the processing of data at any time by notifying the organizer with effect for the future, which will result in exclusion from the sweepstakes.

§ 8 Final Provisions

Should individual provisions of these terms and conditions be or become ineffective, inadmissible, or unenforceable, this shall not affect the validity of the remaining terms and conditions.
