Conditions of participation & privacy policy for the competition
“Tabac Grand Prix Assen ”

1 General

The organizer of the “Tabac Grand Prix Assen ” competition (hereinafter “competition”) is MÄURER & WIRTZ GmbH & Co. KG (hereinafter “organizer”).

The competition is not connected to Instagram or its affiliated companies and is not sponsored, endorsed, or organized by Instagram or its affiliated companies in any way. The recipient of the information provided by the competition entrant is not Instagram or its affiliated companies, but MÄURER & WIRTZ GmbH & Co. KG. The website of MÄURER & WIRTZ GmbH & Co. KG can be found at: www.mw.de . Instagram, Facebook, and its affiliated companies are not the contact persons for questions, comments, or complaints about the competition. All questions, comments, or complaints about the competition should be directed exclusively to MÄURER & WIRTZ GmbH & Co. KG. Instagram and its affiliated companies are indemnified against all damages, losses, and expenses of any kind (including reasonable attorneys' fees and costs) resulting from claims related to the competition (including its publication and organization).

Participation in the competition is generally free of charge, but third parties may incur costs for transmitting participant data, e.g., data connection costs.

2 Competition process

The competition begins on August 29, 2024. Each participant can enter the competition by following the @tabacfragrances channel and liking the post until September 5, 2024.

The winner will be chosen by drawing lots from among all participants who liked the post and followed the account. The winner will be notified of their win via private message by September 6, 2024, and asked to provide the contact information required to send the prize via private message. The notification of their win can be found in the "Other" message folder of your account. If the winner does not respond by September 7, 2024, their right to the prize will be forfeited, and a new winner will be drawn.

After the winner has responded via private message, the prizes will be sent to the winners.

3 prizes

We're giving away two tickets to the Assen Grand Prix sponsored by Tabac Fragrances, including a Tabac product package. The winner also has the chance to win a ride in a two-seater Formula 1 car accompanied by a film crew.
The material will subsequently be used on our social media channels.

The organizer reserves the right to exchange the advertised prizes at any time and replace them with other prizes of equivalent value. In such cases, the winner shall have no claims against the organizer or any legally affiliated companies. Cash payment of the voucher's equivalent value is not possible.

4 Eligibility

The minimum age to participate in the competition is 18 years. Each participant must be a resident of Germany. Employees of the organizer and MÄURER & WIRTZ GmbH & Co. KG, or employees of companies affiliated with the organizer, as well as their family members, are excluded from participation. This rule also applies to freelance and permanent employees of companies and agencies involved in the planning, organization, and execution of the competition.

There is no entitlement to participate in the competition. The organizer may reject entries without giving reasons and reserves the right to exclude participants from the competition who violate these terms and conditions. Participants who attempt to disrupt or manipulate the competition process or to gain an advantage through the use of unauthorized means may also be excluded from participation. Multiple entries are not permitted.

In cases of doubt, the organizer reserves the right to request proof of identity from the winner, e.g., by providing an email address. Failure to provide such proof in a timely manner may result in disqualification from the competition or loss of eligibility to win. Any unnecessary information on the identity document will be communicated to the winner in advance and may be redacted before delivery.

5 General indemnity

With regard to the conduct of the competition, the organizer is only liable for damages resulting from a grossly negligent breach of duty by the organizer or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent. The organizer is also liable for breaches of a material contractual obligation ("cardinal obligation"). In the case of simple negligence, however, this liability is limited to the typical damages foreseeable at the time the contract was concluded. In all other cases, the organizer's liability is expressly excluded.

In particular, the organizer assumes no liability for omissions, interruptions, deletions, delays in the execution of the competition or transmission, failures of communication lines, theft or destruction or unauthorized access to or modification of content and/or messages of the participants.

6 Cancellation of the competition

The organizer reserves the right to cancel or terminate the competition without prior notice and without giving reasons. The organizer will only exercise this option if proper conduct cannot be guaranteed for legal or technical reasons.

7 Data protection information

All data entered and/or uploaded is subject to statutory data protection regulations.

Participation in the competition requires commenting on an Instagram post by the organizer via the participant's personal profile. Depending on the participant's profile settings, personal data such as last name, first name, etc. will be disclosed. The participant's Instagram profile will only be used to determine the winner and to notify them of the prize via private Instagram message. The winner's contact details communicated via Instagram message after the winner is notified, which enable the prizes to be sent by post, will be used by the organizer or a service provider possibly engaged for the purposes of conducting and processing the competition to send the prize with a prize letter. The data will not be used for any other purpose. All personal data will be treated by the organizer in accordance with legal provisions (in particular applicable data protection laws). The organizer is entitled to process the personal data obtained as part of the competition for the aforementioned purpose to the extent necessary in accordance with applicable statutory data protection regulations. After the competition has been conducted and completed, all data will be deleted unless the participant has explicitly requested or consented to further contact or similar. The participant has, among other things, a right to information or correction in accordance with legal requirements and may revoke their participation in the competition and/or the processing of their data at any time by notifying the organizer with future effect. This will result in exclusion from the competition.

8 Final provisions

Should individual provisions of these Conditions of Participation be or become invalid, inadmissible or unenforceable, this shall not affect the validity of the remaining provisions of the Conditions of Participation.
